Terms and Conditions

1. Introduction
These Terms and Conditions of Sale (“Terms”) set out the terms on which Aun Fragrances Ltd. (“we”, “us”, “our”) sells products to you (“you”, “your”) through our website, www.aunfragrances.com (“the Site”).
Please read these Terms carefully before placing an order. By placing an order, you agree to be bound by these Terms and our Privacy Policy. We recommend you save a copy of these Terms for future reference.
2. Your Information
To place an order, you must be at least 18 years old. You warrant that all information you provide during the order process is true and accurate.
3. Formation of the Contract
3.1The presentation of products on our Site constitutes an “invitation to treat”, not an offer to sell.
3.2When you place an order, you are making an offer to purchase the products.
3.3Our acceptance of your order takes place only when we dispatch the products to you. We will send you a dispatch confirmation email. The contract between us (“the Contract”) is formed only upon our dispatch of the products.
3.4We reserve the right to refuse any order for any reason, including but not limited to: product unavailability, errors in product or pricing information, or suspicion of fraudulent activity.
4. Products, Descriptions, and Pricing
4.1. Product Descriptions: We make every effort to ensure that product colours, images, and descriptions are accurate. However, slight variations may occur, and we cannot guarantee that your computer’s display of colours is perfectly accurate.
4.2. Fragrance Disclaimer: The perception of fragrance is highly subjective. We provide descriptions of scents (e.g., “woody,” “citrus,” “floral”) as a guide only. We cannot guarantee that a fragrance will smell exactly as described or react identically on your skin.
4.3. Pricing: All prices are stated in Pounds Sterling (£) and include VAT (where applicable) but exclude delivery charges, which will be added to the total cost. We reserve the right to change prices at any time, but this will not affect orders already accepted.
4.4. Errors: In the event of a manifest error in pricing, we are not obliged to supply the product at the incorrect price. We will inform you and give you the option to reconfirm your order at the correct price or cancel it.
5. Payment
5.1Payment must be made in full at the time of ordering via our secure payment gateway. We accept all major credit/debit cards.
5.2. Your card will be charged at the point we accept your order (upon dispatch).
6. Delivery
6.1. Delivery options and costs are detailed in our separate Shipping Policy.
6.2. We will deliver the products to the address you specify during the order process. You are responsible for ensuring the address is correct.
6.3. The estimated delivery date is not a guaranteed date. We will not be liable for any delays caused by circumstances beyond our reasonable control (a “Force Majeure Event”), including but not limited to postal/courier delays, weather, or customs hold-ups.
6.4. Risk in the products passes to you upon delivery.
7. Your Right to Cancel (The "Cooling-Off Period")
7.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order for any reason within 14 days from the day after you receive the products. This is often called the “cooling-off period”.
7.2. Important Exception for Perfume: Due to hygiene reasons and the nature of sealed fragrance products, you only have the right to cancel and return a product if the seal is unbroken. Once the seal on the product packaging is broken, you lose your right to cancel, as the product is no longer suitable for resale for health protection reasons. This is in accordance with Regulation 28(1)(b) of the Consumer Contracts Regulations.
8. Returns, Refunds, and Faulty Goods
8.1.Returns under the Cooling-Off Period: If you cancel within the 14-day period and the seal is intact, you must return the product to us at your cost, in its original condition and packaging. We will refund the purchase price (excluding original delivery costs) within 14 days of receiving the returned goods.
8.2. Faulty or Damaged Goods: This does not affect your statutory rights under the Consumer Rights Act 2015. If the products are faulty, not as described, or damaged upon delivery, you have the right to a full refund, repair, or replacement. Please contact us immediately at [customer service email].
8.3.Our Returns Policy provides detailed instructions and is incorporated into these Terms.
9. Our Liability
9.1. We are responsible for losses you suffer caused by a breach of these Terms by us, if those losses are a foreseeable consequence of the breach. Losses are foreseeable if they were contemplated by you and us at the time the Contract was formed.
9.2. We do not exclude or limit in any way our liability for:
Personal injury caused by our negligence.
Any breach of the terms implied by the Consumer Rights Act 2015 (that the products are of satisfactory quality, fit for purpose, and as described).
9.3. Subject to clause 9.2, we will not be liable for any loss of profit, loss of business, or any indirect or consequential loss.
10. Intellectual Property
All content on the Site, including text, graphics, logos, and images, is our property or the property of our licensors and is protected by UK and international intellectual property laws. You may not use any content without our express written permission.
11. Prohibited Uses
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:
In any way that violates any applicable UK or international law or regulation.
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
To impersonate or attempt to impersonate Aun Fragrances, an Aun Fragrances employee, another user, or any other person or entity.
To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm Aun Fragrances or users of the Site or expose them to liability.
Additionally, you agree not to:
Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party’s use of the Site.
Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
12. User Contributions
12.1. The Site may contain message boards, review sections, or other interactive features that allow users to post, submit, or display content (“User Contributions”). All User Contributions must comply with our Content Standards (see below).
12.2. You are solely responsible for your User Contributions. You represent and warrant that you own or control all rights in and to your User Contributions and that they are accurate and comply with these Terms.
12.3. We have the right, but not the obligation, to monitor and review User Contributions. We may remove or refuse to post any User Contributions for any or no reason in our sole discretion.
12.4. Content Standards:User Contributions must not:
Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, or inflammatory.
Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
Infringe any patent, trademark, trade secret, copyright, or other intellectual property right of any other person.
Be likely to deceive any person or be made in breach of any legal duty.
13. Reliance on Information Posted
The information presented on or through the Site is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Site, or by anyone who may be informed of any of its contents.
14. Linking to Our Site
You may link to our homepage, provided you do so in a fair and legal manner and do not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists. We reserve the right to withdraw linking permission without notice.
15. Third-Party Links and Resources
If the Site contains links to other sites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.
16. Data Protection
We will process your personal data in accordance with UK data protection law and our Privacy Policy.
17. Events Outside Our Control
We will not be liable for any failure or delay in performing our obligations due to a Force Majeure Event.
18. Governing Law and Jurisdiction
These Terms, and any non-contractual obligations arising from them, are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising from these Terms.
19. Changes to these Terms
We may revise these Terms from time to time. The terms in force at the time you place your order will be the terms that apply to your Contract.
